The Submitter claims that the State of Nicaragua has failed, either through action or omission, to comply with the Political Constitution of the Republic of Nicaragua, specifically articles 23, 24, 25, 27, 26, 46, 47, 48, 52, 55 and 130 as well as Article 641 of the General Law on the Environment and Natural Resources, the Penal Code of Nicaragua, the Law on the Public Prosecutor’s Office and the Penal Procedures Code, as the result of environmental deterioration caused by polluting Lake Masaya in the department of Masaya in the Republic of Nicaragua.
